This Privacy Policy (“Policy”) outlines La Majeste Industries Private Limited (“Company”, “LM”, “MEK”, “we” or “us”) practice in relation to the storage, use, processing, and disclosure of personal data that the user (“you”) have chosen to share with user personal data that we may have access to in relation to your use of our website www.lamajesteindustries.com (“Website”). We are committed to protecting your personal data and respecting your privacy.
2. Please read the following terms of the Policy carefully to understand our practices regarding your personal data and how we will treat it. This Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. 3. Capitalised words not defined in this Policy shall have the same meaning ascribed to them in the Terms and Conditions available at Terms & Conditions (“Terms”). Please read this Policy in consonance with the Terms or the agreement as applicable.
4. By using the Application, you consent to the collection, transfer, storage, use, and disclosure of your personal data, in accordance with this Policy. If you do not agree with the Policy, please do not use or access the Application.
5. This Policy together with our Terms applies to your use of the Application, through your phone, computer, or any other device (“Device”) and of the services accessible through the Application (“Services”).
6. The Application may contain links to other websites. Any personal information about you collected whilst visiting such websites is not governed by this Policy. Softinn shall not be responsible for and has no control over the practices and content of any website accessed using the links contained on the Application. This Policy shall not apply to any information you may disclose to any of the Merchants, which we do not require you to disclose to us or any of the Merchants under this Policy.
7. THE DATA WE COLLECT ABOUT YOU
7.1. We may collect, use, store and transfer different kinds of data about you, including, but not limited to:
(a) Personal data or personal information, means any information about an individual from which that individual can be identified. We may collect, use, store and transfer different kinds of personal data about you to provide you with or in connection with the Services. Such personal data includes:
(i) Identity data - data pertaining to your identity and related data, such as your first and last name, gender, title, birthdate, anniversary.
(ii) Contact data - including email addresses, phone numbers, delivery addresses, business addresses, social media information.
(iii) Location data–location as recorded on your device.
(iv) Health Data - that you may provide during Application on-boarding processes or choose to upload or otherwise store, or cause to be automatically stored due to your interactions on the Application. Please note that healthcare service providers who use the Application to provide you with smart health services may be bound by duties, including statutory duties, of confidentiality in relation to any health or medical information, data, and history that you choose to share through the Application.
(b) The content you may provide to us including reviews, photos, ordering details and history, favourite vendors, special merchant requests and other information, on the Application.
(c) Transaction details related to your use of our Services, and information about your activity on the Services, including the full uniform resource locators (URL), the type of Services you requested or provided including the food and beverage ordered by you, domain names, number of clicks, food habits, length of your visit to our Platform, the date and time you used the Services, amount charged, and other related transaction details.
(d) Aggregated data such as statistical data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data under applicable laws. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific feature of the Services. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.
7.2. You do not have to supply any personal data or information to us, but in doing so, you may not be able to take advantage of all the Services we offer.
7.3. We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions and trade union membership). We also do not collect any information about criminal convictions and offences.
7.4. If you are a Merchant with us, we may collect details including owner details, staff details, addresses, bank details, menu items, restaurant names, contact details, order, bill numbers, table numbers, orders placed by customers, etc.
8. COOKIES:
8.1. We use cookies and/or other tracking technologies to distinguish you from other users of the Application and to remember your preferences. We may use “flash cookies” and similar files or technologies to collect and store information with respect to your use of the Application. This helps us to provide you with a good experience when you use or browse our Application and also allows us to improve the Application.
8.2. Cookies are small files that are stored on your browser or Device by websites, apps, online media and advertisements. We use cookies and similar technologies for purposes such as:
(a) authenticating users;
(b) remembering user preferences and settings;
(c) determining the popularity of the content;
(d) remembering username and password (when applicable);
(e) delivering and measuring the effectiveness of advertising campaigns; and
(f) analysing site traffic and trends, and generally understanding the online behaviours and interests of people who interact with our services.
8.3. The collected data is sent to your browser from the Application and is stored on your Device’s hard drive. It includes information you provide when you use the Application to avail any of our Services and when you report a problem with the Application and our Services. If you contact us, we will keep a record of the information shared during the correspondence.

12. HOW WE USE YOUR PERSONAL DATA AND FOR WHAT PURPOSES
12.1. You understand that when you consent to providing us with your personal data, you also consent to us sharing such data with third parties.
12.2. You are aware that by using the Application, you authorise us to contact you via email, phone, or otherwise. This is to ensure that you are aware of all the features of the Application.
12.3. We reserve the right and discretion to create, use and disclose anonymous and aggregate information, i.e., information about specific individuals or groups of individuals from which personal identifiers have been removed and specific individuals cannot be identified.
12.4. You are aware that any and all information pertaining to you, whether or not you directly provide it to us (via the Application or otherwise), including but not limited to personal correspondence such as emails, instructions from you, etc., may be collected, compiled and shared by us in order to render Services to you and you expressly consent to the same.
12.5. You agree and acknowledge that we may share data without your consent, when it is required by law or by any court or government agency to disclose such information. Such disclosures are made in good faith and belief that it is reasonably necessary to do so in order to comply with any applicable laws and regulations.
12.6. You authorise us to send you electronic alerts and messages for details pertaining to registration on the Application, requirements arising out of the provision of Services, and advertising.
12.7. Further, you agree to receive promotional and other emails and other forms of communication from us. Through such communication, you will receive information about the latest developments of the Application and Services. You may unsubscribe from our mailing list at any time through the “unsubscribe” option we offer.
12.8. In general, we will not disclose personal data except in accordance with the following purpose or activity:
(a) to use the Application;
(b) to process on-Application purchases and managing payments;
(c) to administer and protect our business and this Application including troubleshooting, data analysis and system testing;
(d) to deliver promotional content and advertisements to you;
(e) to make recommendations to you about services which may interest you including recommendations made to you for the choice of food and beverage;
(f) to measure and analyse the effectiveness of the advertising that we serve you;
(g) to understand you and to improve the content and features of our Services;
(h) to monitor trends so we can improve the Application;
(i) to enforce our Terms;
(j) to research upon our user base;
(k) if you are a merchant, to track your usage of the Application;
(l) where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; and
(m) to comply with a legal or regulatory obligation.
13. TRANSFER OF PERSONAL DATA
13.1. As a part of your use of and to ensure better and seamless delivery of the Services to you, the information and personal data you provide to us may be transferred to and stored at countries other than India. This may happen if any of our servers are from time to time located in a country other than India, or one of our service providers is located in a country other than India. We may also share information with entities of countries other than India. These countries shall be subject to data laws of their respective countries.
13.2. By submitting your information and personal data to us, you agree to the transfer, storage, and/or processing of such information and personal data outside the country you are based in.
14. THIRD PARTY LINKS AND USER EXPERIENCE IMPROVEMENT SERVICES
14.1. Our Application may, from time to time, contain links to certain third-party websites or applications. Please note that the third-party websites and any services from them, that may be accessible through our Application have their own privacy policies. Your relationship with these third parties and their services and tools is independent of your relationship with us. We are not responsible for the content or privacy practices of third parties which may be linked on our Services.
14.2. This Policy does not cover the information you choose to provide to or that is collected by these third parties. These third parties may allow you to permit/restrict the information that is collected. It may be in your interest to individually restrict or enable such data collections. We do not accept any responsibility or liability for the policies or for any personal data that may be collected through the third-party websites or their services. Please check their policies before you submit any personal data to such websites or use their services.
15. DATA SECURITY
15.1. We use reasonable efforts to protect your personal information from unauthorised access. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. The security measures undertaken by us are in compliance with the security practices and procedures as prescribed under the Information Technology Act, 2000 and the applicable rules (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information Rules, 2011).
15.2. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Application, you are responsible for keeping this password confidential. We ask you not to share the password with anyone.
15.3. The third-party service providers with respect to payment gateway and payment processing are all validated as compliant with the payment card industry standard (generally referred to as PCI compliant service providers).
15.4. However, you agree and acknowledge that the above-mentioned measures do not guarantee absolute protection. We take best efforts to ensure that your personal information shared with us is secure.
16. DATA RETENTION
We will cease to retain personal data, as soon as it is reasonable to assume that the purpose for collection of such personal data is no longer being served by such retention, and such retention is no longer necessary for legal or business purposes. You are aware that personal data may continue to be stored and retained by us for a reasonable period under applicable law and until it is no longer necessary for any other legal or business purposes (whichever is later).
17. BUSINESS TRANSITIONS
